Another One! Mourinho, Accused Of Defrauding 3.3 Million To The Treasury

Mourinho would have committed two crimes against the Public Treasury in relation to IRPF.

The Economic Crimes Section of the Madrid Public Prosecutor's Office has filed a complaint with the Dean of Education of Pozuelo de Alarcón against Real Madrid ex-coach José Mourinho for defrauding 3.3 million euros of his image rights.

According to the Prosecutor's Office, Mourinho would have committed two crimes against the Public Treasury in relation to Personal Income Tax (IRPF) in 2011 and 2012, when he was training Real Madrid. The amount defrauded amounts to 3,304,670 euros (1,611,537 euros in 2011 and 1,693,133 euros in 2012).

Hacienda issued a report to the Prosecutor's Office which shows that before September 17, 2004, Mourinho signed a contract granting his image rights to the company based in the British Virgin Islands Kooper Services S.A.

And that day he signed a new agreement to transfer his image rights between Kooper and the Irish Multisports & Image Management Limited. Four years later, the Irish company entered into a contract with Polaris Sports Limited, which had the same registered office, to seek and negotiate commercial contracts.

"All these corporate structures were used by the accused in order to make the benefits derived from their image rights physically opaque", emphasizes the Attorney General's Office.

Mourinho signed a work contract with Real Madrid on March 31, 2010 and moved his residence to Madrid, reason for which he acquired the status of fiscal resident in Spain.

However, "with a view to obtaining an illicit benefit," it filed its 2011 and 2012 tax returns in a timely manner without declaring its revenues from the assignment of its image rights.

On July 23, 2014, Hacienda informed Mourinho that it would investigate its personal income tax returns for 2010-2012 and nonresident years 2013 and provided the certificates issued by Global Directors Limited from which it was established that Operating Nominees Limited held for 100% of Kooper.
